These AI Supplemental Terms ( AI Terms ) supplement and are incorporated into the enfusionize Terms of Service ( Terms ). Capitalized terms not defined here have the meanings given in the Terms. If these AI Terms conflict with the Terms, these AI Terms control solely for your use of the AI Features.
PLEASE READ CAREFULLY. BY ACCESSING OR USING ANY AI FEATURES, YOU AGREE TO THESE AI TERMS. IF YOU DO NOT AGREE, DO NOT USE THE AI FEATURES.
1) SCOPE AND DEFINITIONS
• AI Features: generative artificial intelligence functionality available on or through enfusionize.ai and related sites, apps, and tools, including chatbots/assistants, content and image generation, and automation ( AI Features ).
• Inputs: text, data, files, prompts, instructions, or other materials you or your users submit to the AI Features.
• Outputs: text, images, files, or other materials generated by the AI Features in response to Inputs.
2) ACCESS AND USE
Your access to and use of the AI Features is subject to these AI Terms, the Terms, our Privacy Statement, and any documentation or policies we publish. You will comply with all applicable laws when using the AI Features.
3) ACCURACY; VERIFICATION; NO ADVICE
AI systems can be inaccurate, incomplete, or biased. Outputs may contain errors, offensive content, or fail to meet your needs. Outputs are provided for informational purposes only and are not legal, financial, medical, compliance, or other professional advice. You are solely responsible for:
• reviewing and independently verifying all Outputs before relying on them; and
• ensuring your use of Outputs is appropriate for your intended purpose and compliant with law.
4) OWNERSHIP; LICENSES
A. Inputs. As between you and enfusionize , you own your Inputs. You grant enfusionize a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to use, host, store, reproduce, modify, translate, create derivative works from, and process Inputs to provide, operate, maintain, train, and improve the AI Features; perform our obligations under the Terms; enfusionize Policies 2025-09-08 Page 2 and comply with law.
B. Outputs. Outputs may not be unique and the AI Features may generate similar or identical Outputs for others. Outputs may include or be based on content owned by enfusionize , our licensors/providers, or third parties. As between you and enfusionize , you own any portion of an Output that is unique solely to you. Any portion that contains or is based on enfusionize or third-party content remains owned by the applicable owner and is licensed to you only as permitted under these AI Terms and the Terms.
C. Background IP. The AI Features and all related models, software, datasets, and IP are owned by enfusionize and its licensors/providers. Except for the limited rights expressly granted, no rights are granted by implication.
5) TRAINING AND IMPROVEMENT
We may use Inputs and Outputs to operate, train, improve, and develop the AI Features and related services. We will not share your raw Inputs or Outputs directly with other users. Enterprise opt-out: Paid enterprise customers may request a project-specific opt-out from model training by emailing legal@enfusionize.ai and receiving written confirmation. Opt-out does not apply retroactively and may limit certain functionality
6) PERMITTED AND PROHIBITED USES
You will not use the AI Features to:
• develop, train, or improve competing AI or machine learning models, technology, or services;
• mislead others that Outputs were solely human-generated;
• engage in any activity designated high-risk (or similar) under applicable law (e.g., critical infrastructure, medical diagnosis/treatment, credit, housing, employment eligibility, legal determinations, life/safety-critical decisions);
• generate, upload, or distribute content that is illegal, harmful, exploitative, harassing, violent, hateful, or otherwise prohibited by law;
• infringe intellectual property, privacy, publicity, or other rights;
• create deepfakes or impersonate persons without clear, explicit consent;
• include or disclose others sensitive personal data, confidential information, or trade secrets without express rights to do so;
• attempt to extract, reconstruct, or infer underlying models, training data, system prompts, or proprietary information ( model extraction );
• circumvent safety filters, rate limits, or access controls;
• spam, scrape, or harvest data except through documented, permitted APIs.
7) DATA; PRIVACY; SECURITY
• Personal Data: If Inputs/Outputs contain personal data, processing is governed by our Privacy Statement and, where we act as a processor on your behalf, by our Data Processing Addendum (DPA) if executed. Do not submit Protected Health Information (HIPAA), full payment card data enfusionize Policies 2025-09-08 Page 3 (PCI) beyond permitted fields, or other regulated data unless we have agreed in writing to appropriate safeguards.
• Logs: We may retain logs of your AI Feature use (including prompts and metadata) for security, abuse prevention, troubleshooting, and service improvement in accordance with our Privacy Statement.
• Export/Deletion: During your subscription, you may export permitted materials using available features. Upon termination, we will retain relevant materials for a limited period for export (unless legally required to retain longer) and then delete or anonymize them from active systems within a commercially reasonable period.
8) USAGE LIMITS; AVAILABILITY; CHANGES
We may implement or modify usage limits, rate limits, content limits, or other technical controls. Availability may be affected by maintenance windows, provider outages, or events beyond our control. We may modify or discontinue AI Features (or any component) with or without notice.
9) THIRD-PARTY SERVICES AND MODELS
The AI Features may interoperate with or rely on third-party models, APIs, hosting, or services. Your use of third-party services is subject to their terms and privacy policies. We are not responsible for third-party services.
10) BETA/EXPERIMENTAL FEATURES
We may label some AI Features as beta, preview, or experimental. Such features are provided AS IS, may change or be discontinued at any time, and may be subject to additional terms.
11) SUSPENSION AND TERMINATION
We may suspend or terminate access to the AI Features (or remove content) if we believe, in our discretion, that use violates these AI Terms, the Terms, law, or poses risk to users, the public, or our systems. Sections 3 7 and 9 15 survive suspension or termination.
12) WARRANTY DISCLAIMER
ALL AI FEATURES AND OUTPUTS ARE PROVIDED AS IS AND AS AVAILABLE, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, OR RELIABILITY. YOUR BUSINESS RESULTS WILL VARY
13) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LIMITATIONS AND EXCLUSIONS IN THE TERMS APPLY TO YOUR USE OF THE AI FEATURES AND OUTPUTS. WITHOUT LIMITING THE FOREGOING, IN NO EVENT WILL ENFUSIONIZE , ITS AFFILIATES, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, enfusionize Policies 2025-09-08 Page 4 CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, SAVINGS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY RELATING TO THE AI FEATURES IS LIMITED TO THE LESSER OF USD $1,000 OR THE AMOUNTS YOU PAID TO ENFUSIONIZE FOR AI FEATURES IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO PARTS OF THIS SECTION MAY NOT APPLY.
14) INDEMNIFICATION
You will defend, indemnify, and hold harmless enfusionize , its affiliates, and their officers, directors, employees, and agents from and against claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys fees) arising from or related to: (a) your Inputs; (b) your use of Outputs; (c) your use of the AI Features; or (d) your breach of these AI Terms, the Terms, or law.
15) DISPUTE RESOLUTION; GOVERNING TERMS
Disputes arising from or relating to the AI Features will be resolved under the dispute resolution provisions in the Terms (including arbitration and class-action waiver). California law governs as stated in the Terms.
16) CHANGES TO THESE AI TERMS
We may update these AI Terms from time to time. The Last updated date will reflect changes. Your continued use of the AI Features after an update constitutes acceptance.
